Actual Misuse of PI Sufficient to Establish Injury

A North Carolina Court confirms that plaintiffs do not need to suffer out-of-pocket loss to establish injury-in-fact; it is sufficient to allege actual misuse of PI in the form of fraudulent charges on credit cards and unauthorized access and misuse of PI published on the dark web, which goes beyond the realm of speculative harm and into the realm of sufficiently imminent and particularized harm.
