If passed, the ENCRYPT Act would pre-empt state decryption requirements and prohibit any state or political subdivision from requiring the decryption of a product or service, or alteration of security functions to allow surveillance of a user or physical search of a product; a product or service may not be blocked from the market on the basis that it uses encryption or a similar security function.
