Effective January 1 2022, law enforcement agencies cannot obtain household electronic data or direct the acquisition of this data from a private third party, unless authorised by the Act; agencies may be able to obtain the data if it first obtains a warrant under the code of criminal procedure or responds to a call for emergency services (concerning the user of a household electronic device), or in an emergency situation and if criminal charges are not filed, the data must be destroyed within 60 days.
