Liability: Cruise Company Must be Held Responsible for Illegal Robocalls

Advocates highlight that the company cannot escape liability because of a boilerplate provision requiring a third-party marketing company to comply with the TCPA without exercising any oversight or due diligence to ensure that the leads generated were TCPA compliant; allowing companies to contract out TCPA liability would incentivize sellers to take a hands-off approach to compliance and claim ignorance of their contractors’ practices.
