In response to rising complaints, the FTC cautions companies against using negative option marketing as dark patterns to trick or mislead consumers into subscriptions or renewals, pointing to applicable legal obligations in the FTC Act, ROSCA, Telemarketing Sales Rule and Prenotification Plan Rule; prior express informed consent under these laws must be separately obtained, unambiguously affirmative and verifiable.
