Nine Months Before New Virginia Privacy Law

Virginia Consumer Data Protection Act

January 1, 2023 is the day that the Virginia Consumer Data Protection Act will come into affect. Following in California’s footsteps, this comprehensive online data protection law will protect consumers and their data.

The Act will apply to any organization that are over a certain size that do business in Virginia or have users in Virginia.

Key principles

  • Confirmation if a controller has your information and if so, a right to see it
  • Correction of any inaccuracies in the data the controller holds
  • Deletion of any personal data provided by you or obtained about you on request
  • Opt out; ability to opt out of targeted marketing, not to have data sold to a third party or “profiling in furtherance of decisions that produce legal or similarly significant effects concerning the consumer.”
